ABSTRACT

Although apparently identical to that of the traditional international law-making process, international environmental law is heavily infl uenced by diverse actors, formal and informal sources of law and a unique negotiation process. This chapter presents a concise overview of these fundamental aspects. In particular it addresses the involvement of multiple actors in the process of negotiation, including states, international organisations, non-governmental organisations, the scientifi c community and individuals as well as indigenous peoples. The framework type treaty – commonly used in international environmental law – is another progressive development which this chapter also explores along with the broader range of international environmental law sources.
