ABSTRACT

The criminalisation of behaviour that manifests prejudice or group hatred is not a new legal phenomenon. There is a long history in parts of Europe and the US of criminalising racial and ethno-religious propaganda, intimidation and incitement to violence. Since the 1980s, however, western nations have witnessed a proliferation of criminal laws specifically designed to address what has come to be called the problem of ‘hate crime’.
